Knotts Need Hand Up!
My husband Aron Knotts and I Kimberly Knotts are in a very desolate position. Mental and physical health conditions have made getting and maintaining employment. Especially when our vehicles are not street legal and need to be fixed up and maintenanced for safety. We have been promised jobs within a friends business, that can be very flexible and understanding of our chronic conditions.
I used to work as a RN full-time until my mental and physical conditions made even daily life difficult to manage. My husband worked as laborer for over 20 years before his physical health problems made it unsafe and extremely painful to do that sort of work, so he became a professional tattoo artist. I worked night shift at a hospital and he worked 2nd shift Full-time as an artist and manager at a tattoo shop. Both of us wrongfully lost our jobs that we loved working at, worked hard at, enjoyed working with most our coworkers and were very talented at.
When Covid19 shutdown of schools started, I stayed at home with my oldest and only son with nonverbal autism and my 3 younger daughters. My husband's shop was also closed down and while he collected Pandemic Unemployment benefits but got paid $300 monthly for base and the $600 a week extra each week for the bonus stimulus. While processing my unemployment they made a mistake and applied me to regular UE benefits. It took 18 months for me to get my UE benefits. We had to borrow money and use credit to pay for bills and daily expenses.
During the last few years we had to allow family take temporary custody of our kids while we get stable with our health and financial positions. My husband has a son from a previous marriage. Both of us have to pay monthly child support and are now in contempt and being threatened with jail. We both are trying to get income. We rented my children's rooms to help pay bills, but it's not enough.
I am applying to every job I'm qualified for. I volunteered to turn in my RN license, as my mental and physical health would make it dangerous and impossible for me to any type of work that needs to be done in a certain way and time. I have applied for long term disability twice. Once in the beginning of 2022 and was denied the same month my dad was diagnosed with pancreatic cancer. With so much going on, including my dad dying 3 months later, I was unable to appeal SSAs denial.
In the beginning of 2023, I applied for SSDI again and was referred to a disability representative that I thought was a lawyer. They never corrected me when I asked if the lawyer could help with my child support contempt court. The SSA denied my appeal and then asked if I wanted to go to a hearing. My representative told the SSA, that I refused medical treatment, didn't follow medical plans or turn in medical documents and that they were dumping me as a client. So, I then had to find representation for my disability hearing. I was given 60 days to submit my hearing request. My child support lawyer suggested a lawyer group 45 minutes away as I had called all the options nearby. The other lawyers refused to take me on, only because I owed arrears for child support and told me to pay my CS in full. My new lawyer for disability is confident that he can get me approved for my long-term disability but getting a hearing for disability appeal can take a very long time.
During this time my husband and I have been taken to court for non payment of CS. I also am i contempt of my divorce agreement. 10 years ago my exhusband gaslighted me into using his VA benefits to get a mortgage. Then 2 years later he wanted to refinance the VA mortgage to get a lower annual APR, lower rates and payments and that he didn't like Wells Fargo as our loan officer. We started the refinance and then I got evidence that he had cheated on me many times. He also verbally, mentally, emotionally and spiritually assaulted me and he also bullied and physically assaulted our 4 kids. We continued the refinance while we separated. He had abandoned his kids to go 1000 miles away to create a new family. He took all the money from the Refinance to pay of his $25000 in debt and instead of removing himself from the VA loan, he didn't. Our divorce agreement was for him to give me a quite deed and I to assume his VA loan, which I mad my monthly payments. He sent me a blank quit deed printed from the internet. So I had a professional draw me one up for $75. He refused to reimburse me. I told him I had to wait 5 years to remove him from the deed because I would have to immediately pay the mortgage in full. He took me to court and told them I refused to get the loan out of his name because he wanted to buy a home for his new family. He didn't tell them that we Refinanced the mortgage right before our divorce. The divorce agreement stated the Mortgage not the refinance. Our home also wasn't valued high enough at that time to get enough to refinance or sell it and have enough money even with me and my new husband to afford it.
My exhusband again has taken me to court for contempt of our divorce agreement related to his VA mortgage. During Covid19, I used the forbearance plan, and when that ended I was given several options. They requested my exhusband to give me a quit deed to remove himself from the mortgage. He refused and I was unable to modify the loan at all! My mortgage company recommended using the federal Homeowners Assistance Program and even though it took forever to get the proper documentation, I was able to get my arrears paid off and get 6 months paid up. February 2024 was the last month. The judge sided with my exhusband this time and now we have 60 days to sell our home. My ex had our house appraised, by the outside only. This house is not updated and needs a lot of fixing up This, as my ex did shotty work and the home was crappy to start with. The judge and lawyers believe I will make a lot with the market being good, along with how much I still owe the mortgage and the "appraisal". I was also told my exhusband wants a cut if I get a "landslide" of money from the sale. My exhusband never paid anything on this home. He got deployed right after we applied for the mortgage and was only physically in the home just under 2 years. My student loans and RN job had paid for the mortgage. He "stayed home" watching his own kids while his mom lived with us. She actually watched our kids while he cheated, drank, spent every bit of income we got and partied, especially on his NationalGuard drill weekend and training. When he left, I had to get stuck with paying off his debts while paying the mortgage.
Now, my husband and I are looking to be put in jail. for 177 days each, because of owing child support. Even though we would be even more behind in CS, and having an arrest and jail time on our records will make it even harder to get jobs. I also take a ton of medications daily, have therapies, countless monthly Dr appointments, and my SSDI appeal won't be able to be done until after I'm out. My husband needs $555 exactly or more before March 26, 2024 or he will be sentenced. I was lucky my judge and lawyer stood up for me in court. First, the judge acknowledged I pleaded contempt earlier that day for my mortgage and agreed to sell my home, as well as my lawyer stated I have an actual disability lawyer on my SSDI case and I am waiting for my appeal hearing date. The judge went to law school with my disability lawyer as well. I have to pay a few hundred dollars, in good faith, this month of March, to stay out of jail and have to go back to court April 16, 2024.
Hopefully my house will sell for a good amount, we can fix, insure and register our vehicles so we can get the job we are promised and my SSDI hearing gets scheduled soon and I get approved quickly. Right now we would be happy with $555 for my husband's Child Support, $433 for my child support, $278 for our electric bill, $89 for our natural gas bill, $300 for tires on my husband's car, $1100 for 6 months of care insurance, $19 for my dads death certificate, $90 for my dads car probate court ownership change, and $350 for registration and fees for that car.
This is just over $3200. I have asked for friends and family to help as well as government and got absolutely nothing. We used to help out everyone else and those people will not even repay the favor. I even promised to reimburse them with my SSDI awarded retroactive and backpay, once I win my SSA disability hearing. If I don't have to repay, that will help us with getting more stable housing.
